RETURNS & REFUNDS POLICY

Last updated: 30 September 2026

At Ever and Always Gifts, we take care in preparing and packing every order and want you and your gift recipient to be happy with your purchase.

This policy explains our approach to change-of-mind returns, damaged or incorrect orders, cancellations and returned deliveries.

Nothing in this policy limits or excludes your rights under the Australian Consumer Law.

Change of Mind

Please choose your products carefully.

Ever and Always Gifts does not accept returns, exchanges or provide refunds for change of mind.

This includes where:

  • you accidentally select the wrong product, hamper, colour, fragrance or other option;

  • you change your mind after placing your order;

  • the recipient no longer wants or needs the gift; or

  • you find a similar product elsewhere.

This change-of-mind policy does not affect your rights where a product is faulty, damaged, incorrect, not as described or otherwise fails to meet a consumer guarantee under the Australian Consumer Law.

Faulty, Damaged, Incorrect or Missing Items

If your order:

  • arrives damaged;

  • contains a faulty product;

  • contains an incorrect product;

  • is missing an item;

  • is significantly different from its description; or

  • otherwise does not meet an applicable consumer guarantee,

please contact us as soon as reasonably possible at:

everandalwaysgifts@outlook.com

Please provide your order number, a description of the issue and, where possible, photographs of the product, hamper and/or delivery packaging.

Photographs and packaging may help us investigate damage with our delivery provider, but providing original packaging is not a condition of exercising your rights under the Australian Consumer Law.

Please do not dispose of a damaged item or packaging until we have had an opportunity to discuss the issue with you, where it is reasonable for you to retain them.

We will assess the issue and work with you to provide an appropriate remedy.

Depending on the circumstances and your rights under the Australian Consumer Law, this may include a replacement, refund or another appropriate remedy.

Returning a Product with a Problem

Please contact us before returning an item so that we can provide appropriate instructions.

If a product is confirmed to have a problem covered by the Australian Consumer Law, we will reimburse any reasonable return postage or transport costs you were required to pay, where required by law.

In some circumstances, we may arrange collection or determine that returning the affected product is unnecessary.

Nothing in this section limits your rights under the Australian Consumer Law.

Deliveries Returned to Us

A hamper may be returned to us if delivery cannot be completed.

This may occur where:

  • an incorrect or incomplete delivery address was provided;

  • the recipient has moved;

  • the recipient refuses delivery;

  • a collection or redelivery notice is not acted upon;

  • the courier cannot gain access to the property or building;

  • the courier cannot contact the recipient; or

  • the parcel cannot be safely left at the delivery address.

Customers are responsible for checking the recipient's name, delivery address and contact information carefully before completing an order.

If a parcel is returned to us, we will contact you to discuss the options available.

Where the return or failed delivery occurred because of an incorrect address or another circumstance within the reasonable control of you or the recipient, additional redelivery charges may apply.

We will tell you about the applicable charge before arranging redelivery.

If a returned hamper contains food or other items that are no longer suitable to resend because of the time spent in transit or storage, we will discuss the available options with you. Reasonable replacement costs may apply where the failed delivery resulted from incorrect information or circumstances within your or the recipient's control.

This does not apply where the failed delivery was caused by us or where you are otherwise entitled to a remedy under the Australian Consumer Law.

Incorrect Delivery Address

Please check the delivery address carefully before submitting your order.

If you notice an error, contact us as soon as possible.

We will make reasonable efforts to update the address before dispatch, but we cannot guarantee that an address can be changed once an order has been processed or handed to the delivery provider.

We also cannot guarantee that a parcel can be redirected once it is in transit.

Where additional courier, return or redelivery charges arise because an incorrect or incomplete address was provided, those reasonable charges may be passed on to you.

Changes and Cancellations

If you need to change or cancel an order, please contact us as soon as possible at:

everandalwaysgifts@outlook.com

We will let you know whether the requested change or cancellation is still possible.

Because we may begin preparing and packing orders shortly after they are placed, we cannot guarantee that an order can be changed or cancelled once processing has begun.

Once an order has been dispatched, we generally cannot cancel it or guarantee changes to its delivery address.

If we are able to cancel an order before it has been prepared or dispatched, we will arrange a refund of the amount paid for the cancelled order.

This section does not affect your rights where a product is faulty, damaged, incorrect or otherwise fails to meet a consumer guarantee.

Order Cancelled by Ever and Always Gifts

Occasionally, we may be unable to fulfil an order because of circumstances such as product unavailability, an obvious pricing or listing error, suspected fraudulent activity or an inability to deliver to the requested location.

If we cancel all or part of an order after payment has been received, we will refund the amount paid for the cancelled product or order.

Where appropriate, we may contact you first to offer a suitable substitute or alternative.

You are not required to accept a substitute that materially changes what you ordered.

Product Substitutions

Gift hampers may occasionally require a product substitution because individual products, flavours, packaging or other components can become unavailable.

Where this occurs, we may substitute an unavailable item with a product of a similar type and equal or greater value.

We will make reasonable efforts to maintain the overall quality, style and value of the hamper.

If a proposed substitution would materially change the nature of your order, we will make reasonable efforts to contact you before completing the order.

Please refer to our Terms of Service for further information about product substitutions.

Refund Processing

Where a refund is approved, it will generally be issued to the original payment method used for the order, unless another arrangement is agreed with you.

After we issue a refund, the time it takes to appear in your account may depend on your bank, card issuer or payment provider.

Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Where a product has a major problem, Australian Consumer Law may give you the right to choose between a refund or replacement.

For a problem that is not major, we are entitled to provide an appropriate remedy in accordance with the Australian Consumer Law.

Nothing in this Returns & Refunds Policy excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded.
